LIMITED WARRANTY BY TOOFFAIRY LABS ON INSTALLATION KITS.
Dentures, Nightguards, and Retainers manufactured by ToofFairy Labs are identified to be free from defects in materials or workmanship. In the case of a defective product, a 3 month warranty is automatically in effect from the date of delivery of your final product & in addition, a 6 month extended warranty from the date of delivery of your final product can be acquired from our site for $59.99. The warranties cannot be stacked. The 6 month warranty is only available when purchased simultaneously with your order and is applied to all orders at checkout, excluding gels. Within the applicable period, ToofFairy Labs will honor any repair of products/components purchased at no charge. If a replacement is required due to a lost product, ToofFairy Labs will charge 50% of the original product price if replacement is within the warranties applicable period. Any additional replacements after that will be subject to a 75% charge of the products original price if replacement occurs during either warranty period. If a replacement occurs outside of either warranty period, you will be subject to the full charge of the products price. In order for repairs of broken products to be honored, ALL broken components must be returned. No exceptions.
There will be no charge for labor incurred in making a replacement under your warranty, provided that: (i) the labor is performed by ToofFairy Labs at its facility in California, and (ii) the consumer has purchased our 6 month warranty. In cases outside of our warranty, the consumer shall be responsible for all costs of shipping, packaging, handling or transportation, including any import or export fees, taxes, customs, tariffs or similar charges.
The warranty provided and our extended warranty available for purchase does not apply to: (i) Any change in the original impression (i.e. another tooth is extracted); (ii) Whitening Gel packs and Anti-Snoring Devices; (iii) Damage caused by service performed by anyone who is not explicitly authorized in writing by ToofFairy Labs to be one of our dental technicians; (iv) Damage to a product that has been modified or altered without the written authorization of ToofFairy Labs.
ToofFairy Labs reserves the right to refuse warranty claims against products that have been installed or used in contravention of any terms set out in the paragraphs above.
THE WARRANTIES AND REMEDIES CONTAINED HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESSED, IMPLIED OR STATUTORY, INCLUDING ANY LIABILITY ARISING UNDER ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, STATUTORY OR OTHERWISE. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, WHICH MAY VARY FROM STATE TO STATE.
IN NO EVENT SHALL TOOFFAIRY LABS BE HELD LIABLE IN A CLAIM FOR BREACH OF WARRANTY FOR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, WHETHER RESULTING FROM THE USE, MISUSE OR INABILITY TO USE THE PRODUCT OR FROM DEFECTS IN THE PRODUCT.
ToofFairy Labs retains the exclusive right to repair or replace (with a new, remanufactured or newly-overhauled replacement) the product or offer a full refund at the purchase price at its sole discretion. SUCH REMEDY SHALL BE YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY BREACH OF WARRANTY.
